These App Terms of Service ("Terms") govern your access to and use of the TerritoryIQ mobile application (the "App") provided by TerritoryIQ Enterprises LLC ("TerritoryIQ," "we," "us," or "our"). They apply specifically to the App and are in addition to our general Terms & Conditions. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old and able to form a binding contract to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
The App provides mobile access to the TerritoryIQ CRM platform for door-to-door and field sales professionals, including lead and pipeline management, follow-up automation, and communication features. We may modify, suspend, or discontinue any part of the App at any time.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for your internal business use and in accordance with these Terms and the applicable app store's terms. You may not copy, modify, reverse engineer, or distribute the App except as permitted by law.
Access to paid features requires an active subscription. Subscriptions and payments are handled through our external checkout, not as an in-app purchase, at the rates presented at sign-up. Fees are charged in advance and are non-refundable except as required by law or expressly stated. Subscriptions renew automatically unless cancelled before the renewal date. We may change pricing on prospective notice, effective at your next billing cycle.
You agree not to use the App to: violate any law or regulation; send unlawful, harassing, deceptive, or unsolicited messages; infringe intellectual property or privacy rights; transmit malware; or attempt to gain unauthorized access to the App or its systems. You are solely responsible for the content you transmit and for obtaining all required consents from the individuals you contact through the App.
If you use the App to send SMS/text messages to your own leads or customers, you are responsible for complying with all applicable laws and industry standards, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and carrier requirements. You must obtain proper opt-in consent, honor opt-out requests, and provide the required program disclosures to your recipients. Additional messaging terms are set out in our Terms & Conditions.
You may delete your account and associated personal data at any time from within the App, as described in our App Privacy Policy.
The App, including all software, content, trademarks, and branding (including "TerritoryIQ"), is owned by TerritoryIQ Enterprises LLC or its licensors and is protected by intellectual property laws. You retain ownership of the data you input into the App.
The App is built on and integrates with third-party platforms and providers, and is distributed through third-party app stores (such as the Apple App Store and Google Play). Your download and use of the App are also subject to the applicable app store's terms. The app store providers are not responsible for the App or its support, and are not parties to these Terms, except that they may be third-party beneficiaries entitled to enforce these Terms against you. We are not responsible for third-party services we do not control.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, TerritoryIQ Enterprises LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the App. Our total liability for any claim will not exceed the amount you paid us for the Services in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless TerritoryIQ Enterprises LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your content, or your violation of these Terms or applicable law, including messaging and consent laws.
We may suspend or terminate your access to the App at any time for violation of these Terms or for any conduct we reasonably believe is harmful to the App or other users. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
